Terms of Service — ABAshifts

1. Overview

ABAshifts (“the Platform”) is a matching service that connects ABA therapy companies (“Companies”) with Registered Behavior Technicians and Board Certified Behavior Analysts (“Therapists”) for supplemental shift work. By using the Platform, you agree to these terms.

2. The Platform's Role

ABAshifts is a matching and communication platform. We are not an employer, staffing agency, or employment broker. We do not:

Employ, supervise, or manage therapists
Guarantee the quality, reliability, or performance of any user
Set pay rates, schedules, or working conditions between parties
Provide insurance, workers' compensation, or benefits

The working relationship formed through ABAshifts is between the Company and Therapist. Both parties are responsible for ensuring compliance with applicable employment laws, including proper W-2 classification for RBTs.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to:

Provide accurate and truthful information
Keep your profile and availability up to date
Not impersonate another person or entity
Not use the platform for any unlawful purpose

4. Therapist-Specific Terms

As a Therapist on the Platform, you represent that:

You hold a valid, current BACB certification (RBT or BCBA)
The certification information you provide is accurate
Your availability schedule accurately reflects your actual availability
You understand that shifts on the Platform are supplemental (capped at 20 hours/week)
You are responsible for ensuring that supplemental work does not violate any existing employment agreements

5. Company-Specific Terms

As a Company on the Platform, you represent that:

You are an authorized representative of the company
Shift postings accurately describe the role, schedule, pay, and requirements
You will properly classify and compensate therapists hired through the Platform in accordance with applicable employment laws
All shifts posted are capped at 20 hours per week per the Platform's rules

6. Fees and Payments

For Companies: You agree to pay a $49 fee per shift posted and a $5 fee per confirmed match. Posting fees are non-refundable. Match fees are charged only upon mutual confirmation.

For Therapists: The Platform is free. No fees will be charged for creating a profile, browsing shifts, expressing interest, messaging, or matching.

We reserve the right to modify pricing with 30 days' notice. Existing rates may be honored for founding members at our discretion.

7. Anonymity and Identity Reveal

Therapist identities are anonymous until explicit match confirmation. Companies must not attempt to identify therapists outside of the Platform's reveal process. Any attempt to circumvent the anonymity system may result in account suspension.

8. Prohibited Conduct

You may not:

Use the Platform to facilitate full-time employment arrangements (shifts are supplemental only)
Attempt to identify anonymous users outside of the match process
Share another user's personal information without consent
Post misleading or fraudulent shift listings
Use the Platform to harass, spam, or solicit users
Scrape, crawl, or extract data from the Platform

9. Limitation of Liability

ABAshifts provides the Platform “as is” without warranties of any kind. We are not liable for any damages arising from use of the Platform, including but not limited to: failed matches, no-shows, credential misrepresentation, or disputes between Companies and Therapists.

10. Account Termination

You may deactivate or delete your account at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be handled in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or platform notification. Continued use of the Platform after changes constitutes acceptance of the updated terms.
